Secure and verifiable identification

Identification requirements

For the disbursement of those public services, including law enforcement services, in this state, which require recipients to produce identification, no department, agency, commission, or other public entity in this state, or a political subdivision therein, may accept or recognize any identification document unless such document was issued by a State or Federal authority, and is verifiable by U.S. law enforcement agencies. No public entity in this state may authorize acceptance of other than such verifiable identification, nor may any public official acting in his or her capacity as a public official accept, acknowledge, or recognize other than such verifiable identification. Nor may any public entity in this state, rely on, or utilize in any manner, other than such verifiable identification for the purpose of issuing to any person any form of identification, license, permit, or official document.

Exceptions

Exceptions to previous section shall be made only as mandated by Federal law, and for the purpose of reporting a crime.

Consequences

Policies enacted that are inconsistent with the provisions of this act will be deemed outside the official capacity of the public entity enacting such policies, and will render such public entity ineligible for governmental immunity.

Definitions

For the purposes of this Act, the word "verifiable" shall be taken to mean that the issuance of a document by the issuing agency to the individual named on the document is capable of being confirmed upon request by a U.S. law enforcement agency.

For the purposes of this Act, the term "U.S. law enforcement agencies" shall be taken to include all law enforcement or intelligence agencies, departments, and authorities of the Federal government, or of a State government or a political subdivision thereof.
